Terms of Service

1. Introduction

These Terms and Conditions (“Terms”) govern the relationship between the Client (“You”) and Westom Tomasz Węsierski (“Havena”, “We”, “Us”), with its registered office at ul. Żeromskiego 5, 81-346 Gdynia, Poland, Tax ID (NIP): 5861433097.

By applying for membership or booking a protocol, you agree to be bound by these Terms.

2. Nature of Services

Havena provides wellness consultancy, logistical coordination, and concierge services. Our role is to curate and organize your stay, transport, and schedule appointments with third-party service providers.

CRITICAL MEDICAL DISCLAIMER:
Havena (Westom Tomasz Węsierski) is NOT a medical facility, hospital, or clinic. We do not employ doctors directly. All medical procedures, diagnostics, and therapies are performed by independent, licensed third-party entities. The medical contract is formed directly between You and the Medical Provider. Havena is not liable for the outcome of any medical procedure.

3. Booking & Payments

• Application: Access to Havena is by application only. We reserve the right to decline any application without providing a reason.
• Deposit: A non-refundable deposit (typically 30%) is required to secure your slot and initiate the logistical setup.
• Balance: The remaining balance must be cleared 14 days prior to arrival.

4. Cancellation Policy

Due to the exclusive nature of our cohorts and the reservation of specialized medical equipment:

• Cancellations >30 days before arrival: Full refund minus the non-refundable deposit.
• Cancellations 14-30 days before arrival: 50% refund of the total fee.
• Cancellations <14 days before arrival: No refund.

5. Client Responsibilities

You agree to disclose all relevant medical history truthfully during the screening process. Havena reserves the right to terminate the protocol immediately (without refund) if undisclosed medical conditions pose a safety risk to You or our staff.

6. Limitation of Liability

To the fullest extent permitted by Polish law, Westom Tomasz Węsierski shall not be liable for any indirect, incidental, or consequential damages arising from the use of our services. Our total liability is limited to the amount paid by You for the logistical service fee.

7. Intellectual Property

All “Havena” protocols, methodologies, and branding are the intellectual property of Westom Tomasz Węsierski. You may not reproduce or use our operational frameworks for commercial purposes.

8. Governing Law & Jurisdiction

These Terms are governed by the laws of the Republic of Poland. Any disputes shall be resolved by the competent court having jurisdiction over the seat of the Operator (Gdynia, Poland).
